Derek S. Wilczynski
Derek S. Wilczynski, a partner at Blanco Wilczynski, P.L.L.C., joined the firm in March of 2003. Mr. Wilczynski leads the firm’s General Practice section, and also practices in the areas of Criminal Law—including DUI defense, Immigration Law, Family Law, and Identity Theft and Credit Protection Law. In addition, Mr. Wilczynski litigates for the firm’s transportation and EMS clients in the areas of general liability and Worker’s Compensation.
Mr. Wilczynski was previously an associate attorney at Willmarth, Tanoury, where his practice was split between medical malpractice, primarily for the Detroit Medical Center and Oakwood Hospital, and general liability defense, primarily for Target, Mervyn’s, and Office Max. In June of 2000, Mr. Wilczynski became associated with Johnson, Rosati, LaBarge, Aseltyne & Field, P.C. His practice was general, with a focus on Family Law, Criminal Defense and Civil Litigation defense (primarily in the Municipal Law area). Mr. Wilczynski has developed significant trial experience as the Assistant Municipal Attorney for Harper Woods and Richmond Township in the State of Michigan.
Mr. Wilczynski graduated from Oakland University in 1993, where he received a B.A. in Political Science, with minors in History and Communications. While at Oakland University, Mr. Wilczynski was President of the student body from 1992-1993. Mr. Wilczynski graduated from Wayne State University, where he received his Juris Doctor in 1997. While at Wayne State, Mr. Wilczynski was a member of the Student Board of Governors. Mr. Wilczynski was admitted to practice in November of 1997.
Mr. Wilczynski has served as a member of the Board of Directors of the Young Lawyers’ Section of the Macomb County Bar Association, and as a member of the general section of the Macomb County Bar Association. He is an active member of the Advocates Polish American Bar Association, the Polish Century Club, and Rotary International.

Wilczynski successfully defended a client accused of sexual assault on a minor in Mio, Michigan (Oscoda County). After vigorously conducting discovery, it became clear that Wilczynski’s client not only was not guilty of the charged crime, but also that the victim more than likely suppressed memories of the actual abuse. Wilczynski successfully argued to the Court that the prosecutions expert witness, a child abuse specialist, be precluded from testifying on the grounds that she did not meet the legal standard to provide testimony. It took the jury 20 minutes to reach a not guilty verdict.
In a drunk driving appeal in Gaylord, Michigan, Wilczynski successfully argued on appeal that the Prosecutions “star” rebuttal witness as to the accuracy of the BAC Datamaster was not qualified to testify at trial. The trial court allowed the expert to testify without properly applying evidentiary standards to the witnesses qualifications. On appeal, the Court agreed with Wilczynski that the witness was not qualified to testify and should not have been allowed to provide opinion testimony at trial.
Wilczynski has successfully filed drivers’ license appeals for his clients, resulting in the reinstatement of their driving privileges. Wilczynski’s service to his clients is all-inclusive – once the client is eligible to obtain his/her license, Wilczynski walks them through the process, from intake to the hearing.
