Federal Court Dismisses Constitutional Violations Case Against Ambulance Company
The Federal District Court for the Western District of Michigan dismissed a case against a west-Michigan ambulance company because the company was not a “state actor” and, as a result, not subject to liability under the United States Constitution.
In this case, the Plaintiff claimed that the decedent’s Constitutional rights to due process and protection from unlawful search and seizure were violated by the Defendant ambulance company. Blanco Wilczynski filed a Motion to Dismiss the case on the grounds that the ambulance company was private and, accordingly, was not subject to Constitutional liability.
Federal Judge Jack Zahoury agreed, and dismissed the case as to the ambulance company. Judge Zahoury’s ruling was upheld by the Sixth Circuit Court of Appeals.
